LLA 760 Negligence as misconduct


The article begins by explaining what negligence is, and then lists the elements of this form of misconduct i.e. what an employer who alleges an employee has been negligent must prove and the defences which that employee can raise in response. Each element is explained and examples of negligent conduct in different contexts are discussed.
